    TYPE OF NOTICE

    Offering or granting any inappropriate advantages in business dealings with employees of public authorities or private business partners; abuse of employment or function to obtain inappropriate advantages.

    NUnauthorized removal of objects or materials for one's own use or the needs of others.

    Soliciting money or items from others through fraud; falsification of documents, such as invoices or contracts; mishandling of company assets (for example, creating unregistered cash receipts or accounts).

    Unlawful agreements with competitors regarding prices, allocation of markets, customers or regions, orders, production quantities and quotas, strategies, boycotts, etc. This also includes agreements relating to public procurement and the award of contracts, as well as the exchange of information noncompliant with competition law.

    E.g. unauthorized management of hazardous waste, unauthorized violation of seals on emergency kits, spillage of pollutants into sewage sewers, pollution of public spaces (e.g. by spilling oil and oily substances on roads or into road outlets).

    Any criminal or unlawful conduct of employees that is related to the performance of their work activities in the company, such as sexual harassment, physical violence, intentional submission of a false report; stalking or sanctioning employees who have reported (in good faith) a complaint about a possible suspected violation of ethical principles or legislation.

However, if you provide your email or phone number within the form, we will be able to contact you in case of additional questions, which will make the investigation of the whistleblowing more effective and at the same time we will be able to provide you with feedback on the outcome of the investigation of the notice.     If you voluntarily provide your personal data as part of a non-anonymous notice, they will be processed by the controller: Mobis Slovakia, s.r.o., ID No.: 35 876 557, with its registered office at MOBIS ulica 1, Gbeľany 013 02, registered in the Commercial Register of the District Court Žilina, Section Sro, File 14983/L (hereinafter referred to as the "MSK"), for the purpose of:

    a) the fulfilment of the legal obligation of the MSK stipulated by Act No. 54/2019 Coll. on the Protection of Whistleblowers, as amended, in the event that you have become aware of the facts stated in the report in connection with the performance of your employment, profession, position or function; MSK processes the personal data that you provide as part of the notice (name and surname, address of residence; in the case of an anonymous notification, only a note that it is an anonymous notification is provided) for a period of three years from the date of delivery of the notice (Section 11 (1) of Act No. 54/2019 Coll.).
    b) keeping records and managing notices related to anti-social activities beyond the scope of Act No. 54/2019 Coll., based on your consent to the processing of personal data (voluntary provision of personal data in cases other than those specified in letter a)). In this case, personal data is stored for a period of three years from the date of delivery of the notice.

    We do not publish, disclose or provide your personal data to any other entities, with the exception of law enforcement authorities, courts or other administrative authorities that are entitled to request the said personal data in accordance with applicable law. Your personal data will not be subject to automated processing.

    You have the right to request from us access to your personal data, you have the right to rectification, erasure or restriction of processing, or the right to object to processing, as well as the right to data portability, all within the scope of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) (the 'Regulation'). You have the right to request from MSK a copy of the personal data we hold about you. If you request copies of your personal data repeatedly, we have the right to demand a reasonable fee for this. If you would like to transfer your data to another controller, we will provide you with all personal data that you have provided to us and that have been processed by automated means in a machine-readable and portable format, free of charge. Because we want to make sure that your personal information is accurate and up to date, you can also ask us to correct or delete any information that you believe is inaccurate.

    If you decide to exercise any of the above rights, please send us a clearly worded request, including relevant personal data, provide your first and last name, contact details and date of birth as proof of identity to the contact details below. We may require additional proof of identity to protect your personal data.
